ARTICLE I — DEFINITIONS AND INTERPRETIVE CONVENTIONS

For purposes of this Policy, the following terms have the meanings set forth below:

1.1 “Brand,” “we,” “us,” or “our” means DAVISON FIGHT CLUB, its affiliates, licensors, fulfillment partners, and authorized agents. 1.2 “Customer,” “you,” or “your” means the person or entity completing a purchase through any authorized channel of the Brand. 1.3 “Goods” means all merchandise offered by the Brand, including rashguards, fight shorts, hoodies, track jackets, headwear, accessories, and related products. 1.4 “Manufacturing Defect” means a material deviation from production specifications that affects structural integrity or intended function and that was present at delivery. It does not include normal wear, laundering effects, training abrasion, dye transfer, pilling, or minor cosmetic variations inherent to sublimation printing and small-batch production. 1.5 “Fulfillment Error” means shipment of an item that differs materially from the style, colorway, or size shown on the order confirmation. 1.6 “Transit Damage” means physical damage occurring after the carrier takes possession and before delivery, supported by evidence of damage to both outer packaging and contents. 1.7 “Claim Window” means the 72-hour period beginning at the carrier-recorded time of delivery. 1.8 Headings are for convenience only. The singular includes the plural and vice versa. “Including” means “including without limitation.”

ARTICLE II — SCOPE AND APPLICABILITY

2.1 This Policy applies to all purchases made through the Brand’s online store, authorized marketplaces, social commerce channels, and any official pop-up or direct-sale events. 2.2 This Policy forms part of the Brand’s Terms of Service and is a material term of each sale. 2.3 This Policy is disclosed prior to purchase (site footer, product pages, checkout, and order confirmation email) in accordance with California Civil Code § 1723. 2.4 No employee, ambassador, athlete, or agent may waive or modify this Policy without written authorization from ownership. 2.5 Items purchased from third-party resellers or secondary markets fall outside this Policy.

ARTICLE III — OUR APPROACH TO ADJUSTMENTS

Because our products are performance garments designed for direct skin contact in training environments, and because we produce in limited quantities (including made-to-order pieces), we carefully evaluate adjustment requests. We focus our resources on remedying clear issues with the product or fulfillment process rather than preference-based returns.

The purchase price reflects the efficiencies of this model. Nothing in this Policy limits any non-waivable rights you may have under applicable consumer protection law.

ARTICLE IV — QUALIFYING CIRCUMSTANCES

We will address the following situations:

4.1 Manufacturing Defect — If Goods show a Manufacturing Defect present at delivery and reported within the Claim Window, we will, at our discretion, replace the item (if available), substitute a comparable item of equal value, or issue a refund to the original payment method.

4.2 Fulfillment Error — If we ship the wrong style, color, or size, we will send the correct item at no charge and provide a prepaid return label for the incorrect item (which must be returned unworn, unwashed, and with original tags).

4.3 Transit Damage — If Goods arrive damaged and supported by photos of both packaging and contents, we will pursue a carrier claim and provide a replacement or refund once resolved.

Situations that do not qualify include (without limitation):

  • Dissatisfaction with fit, cut, compression, or silhouette
  • Dissatisfaction with color, print scale, graphic placement, or design
  • Differences between delivered item and product photos caused by screen settings or lighting
  • Change of mind, duplicate order, or changed circumstances
  • Damage from use, training, competition, or improper care
  • Alterations, heat-pressing, or embellishments made after delivery
  • Normal wear (pilling, seam relaxation, elastic fatigue, print softening)
  • Minor cosmetic variations inherent to sublimation printing or production batches
  • Claims submitted after the Claim Window or without required documentation

ARTICLE V — CLAIM PROCEDURE

5.1 Claims must be submitted by email to the address in Article XVI within the Claim Window. Social media messages do not count as formal claims.

5.2 Each claim must include in one email:

  1. Order number
  2. Full name on the order
  3. Description of the issue
  4. At least four clear photos: full garment laid flat, close-up of the affected area, interior care/size label, and shipping package/label
  5. For transit damage: additional photos of exterior packaging as received

5.3 Please keep the Goods and original packaging in as-delivered condition until the claim is resolved. Worn, washed, altered, or discarded items cannot be considered.

5.4 We will acknowledge complete claims within 3 business days and provide a determination within 10 business days.

5.5 No returns are accepted without a written Return Authorization Number. Unauthorized returns will be refused.

5.6 Approved refunds are issued only to the original payment method and typically appear within 5–10 business days (subject to your bank’s processing times).

5.7 Original shipping charges are non-refundable except in cases of our own fulfillment error.

5.8 Our determination under this Article is final with respect to our internal process.

ARTICLE VI — SIZING, FIT, AND PRE-PURCHASE DILIGENCE

6.1 Customers are responsible for selecting the correct size.

6.2 Detailed size charts (imperial and metric) appear on every product page. We recommend measuring a comparable garment you already own.

6.3 Competition rashguards are designed for a compressive fit. A closer fit than everyday athletic wear is intentional.

6.4 Free sizing advice is available before purchase — email height, weight, chest measurement, and preferred fit to the address in Article XVI. Recommendations are advisory only.

6.5 Measurements carry a manufacturing tolerance of up to ½ inch; variance within this range is not a defect.

ARTICLE VII — ORDER MODIFICATION AND CANCELLATION

7.1 Orders may be modified or cancelled free of charge within 60 minutes of placement, provided fulfillment has not begun.

7.2 Requests must be emailed and confirmed in writing by us.

7.3 Once fulfillment has started (picking instruction generated or order sent to production), modification or cancellation is no longer available.

7.4 Address changes are possible only before the carrier takes possession. Packages delivered to an incorrect address supplied by the customer remain the customer’s responsibility.

ARTICLE VIII — PRE-ORDERS, LIMITED DROPS, AND MADE-TO-ORDER

8.1 Pre-orders secure production slots and cannot be cancelled or refunded once placed. The 60-minute window does not apply.

8.2 Estimated ship dates are projections only. Delays from fabric, production, freight, or customs do not create a right to cancel or refund.

8.3 Limited-drop items are produced in fixed quantities; sell-outs do not create substitution or priority rights.

8.4 Made-to-order items are customized and qualify only for Manufacturing Defect remedies under § 4.1.

ARTICLE IX — SHIPMENT, TITLE, AND RISK

9.1 Title and risk of loss transfer when we tender the Goods to the carrier.

9.2 We are not the carrier and are not responsible for transit times or delivery performance.

9.3 Packages marked delivered by the carrier are considered delivered. We do not replace or refund items marked delivered but not received; such issues should be directed to the carrier (and law enforcement if appropriate). We will supply tracking information upon request.

9.4 Signature confirmation or shipping protection (when offered) is recommended. Declining these options means accepting the associated risk.

9.5 Undeliverable packages returned to us may be reshipped only after a second shipping payment. If declined, no refund is available and items are held for 30 days before being considered abandoned.

ARTICLE X — INTERNATIONAL ORDERS

10.1 International orders are Delivered Duty Unpaid. All duties, taxes, and brokerage fees are the customer’s responsibility.

10.2 We do not undervalue shipments or mark commercial goods as gifts.

10.3 Refusal to pay duties resulting in seizure or return does not create a refund right.

10.4 Customs delays are outside our control.

10.5 International orders are not eligible for the transit-damage remedy in § 4.3.

ARTICLE XI — PAYMENT DISPUTES AND CHARGEBACKS

11.1 Please complete the process in Article V before opening a dispute with your bank or payment provider.

11.2 Chargebacks filed without first using Article V will be contested with full order records, policy disclosures, and delivery confirmation.

11.3 Accounts associated with unsupported chargebacks may be restricted from future purchases.

11.4 This section does not limit rights under the Fair Credit Billing Act or payment network rules.

ARTICLE XII — PROMOTIONAL CODES, BUNDLES, AND COMPLIMENTARY ITEMS

12.1 Discount codes must be entered at checkout; we cannot apply them retroactively.

12.2 Later price reductions or new codes do not create adjustment rights on prior orders.

12.3 When a bundle qualifies for remedy, the entire bundle must be returned.

12.4 Complimentary items have no separate monetary value and must be returned with any remedied Goods.

12.5 Gift cards and store credit are non-refundable except where required by law.

ARTICLE XIII — LIMITATION OF LIABILITY

13.1 To the fullest extent permitted by law, our total liability for any claim related to a purchase will not exceed the amount paid for the Goods in question.

13.2 We are not liable for indirect, incidental, consequential, or special damages (including missed events or competition fees).

13.3 Athletic apparel is not protective equipment; we make no claims that any product prevents injury.

13.4 Nothing here excludes liability for fraud, willful misconduct, or liability that cannot be limited by law.

ARTICLE XIV — GOVERNING LAW AND DISPUTE RESOLUTION

14.1 This Policy is governed by California law.

14.2 The parties will attempt good-faith negotiation for at least 30 days before formal proceedings.

14.3 Unresolved disputes will be heard in state or federal courts in Los Angeles County, California.

14.4 Small-claims court remains available where jurisdictional limits allow.

ARTICLE XV — SEVERABILITY, AMENDMENT, AND ENTIRE AGREEMENT

15.1 If any provision is held invalid, the rest remains in effect.

15.2 We may update this Policy at any time. The version in effect at purchase governs that order.

15.3 This Policy, together with our Terms of Service and Privacy Policy, is the complete agreement on returns, refunds, and exchanges.

15.4 Failure to enforce any provision is not a waiver.
