1. DEFINITIONS
1.1 — "Brand," "we," "us," "our" denotes DAVISON FIGHT CLUB, the trade name under which Adam Hassan conducts business, together with its fulfillment and production partners.
1.2 — "Customer," "you," "your" denotes the purchaser.
1.3 — "Processing Time" denotes the interval commencing upon payment authorization and concluding upon tender of the consignment to the carrier.
1.4 — "Transit Time" denotes the interval commencing upon carrier tender and concluding upon delivery.
1.5 — "Business Day" denotes Monday through Friday, exclusive of United States federal holidays. Orders placed after 12:00 p.m. Pacific Time, or on a non-Business Day, are deemed received the following Business Day.
1.6 — "Promised Shipment Date" denotes the tenth Business Day following order receipt.
2. SCOPE AND APPLICABILITY
2.1 — This Policy governs the fulfillment and conveyance of all Goods sold through the Brand's storefront and any authorized channel.
2.2 — This Policy is incorporated by reference into the Brand's Terms of Service and is to be read alongside the Brand's Return, Refund, and Exchange Policy. Where the two documents conflict on a matter of shipment or delivery, this Policy governs.
2.3 — Shipping estimates constitute the Brand's good-faith projection formed upon a reasonable basis. They are estimates as to Transit Time and commitments as to Processing Time.
2.4 — No employee, contractor, ambassador, or agent of the Brand possesses authority to vary this Policy absent express written authorization from ownership.
3. PROCESSING TIME
3.1 — Goods are ordinarily tendered to the carrier within five (5) to ten (10) Business Days of order receipt.
3.2 — The Brand forms this representation upon a reasonable basis grounded in its production capacity, materials availability, and historical fulfillment performance. The Brand does not solicit orders it does not reasonably expect to fulfill within the stated window.
3.3 — Following a high-volume release, Processing Time may extend toward the upper bound of the stated window. This is anticipated and is encompassed within it.
3.4 — Processing Time does not commence until payment is authorized and cleared. Orders held for fraud review, address verification, or payment irregularity toll the Processing clock until resolved. The Brand will contact the Customer where such review requires Customer input.
3.5 — No processing occurs on weekends or federal holidays. Notice of extended closures is posted not fewer than seven (7) days in advance.
3.6 — A request to modify an order after placement suspends processing and restarts the Processing Window from the date the modification is confirmed in writing.
4. TRANSIT TIME AND CARRIERS
4.1 — The Brand tenders consignments to United States Postal Service, United Parcel Service, FedEx, or DHL, as determined by destination and dimensional weight. The Brand may select or substitute a carrier of equal or superior specification without notice.
4.2 — The Brand offers standard shipping only. No expedited or express service level is available at checkout. A Customer requiring delivery by a date certain should contact the Brand prior to purchase to confirm feasibility; the Brand may, at its sole discretion and at the Customer's cost, arrange an accelerated service.
4.3 — Indicative Transit Times following carrier tender:
- Domestic — 2–7 Business Days
- International — 7–21 Business Days
4.4 — Transit Times are the carrier's estimates, not the Brand's guarantee. Network congestion, mechanical interruption, meteorological event, labor action, and customs inspection may extend them.
4.5 — Any accelerated shipping charge remitted under § 4.2 is non-refundable where the consignment was tendered within the Promised Shipment Date and the carrier subsequently failed its own service commitment. Recourse in that circumstance lies against the carrier, and the Brand will furnish documentation in support.
5. DELAYS
This Section conforms to the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule, 16 C.F.R. Part 435.
5.1 — Where the Brand determines it cannot ship on or before the Promised Shipment Date, the Brand will email the Customer promptly upon forming that determination, and no later than the Promised Shipment Date.
5.2 — That notice will state the revised shipment date (or, where no reliable date can be formed, the reason and an express statement to that effect), the Customer's right to cancel for a prompt and full refund, and a cost-free means of cancelling.
5.3 — Where the revised date falls thirty (30) days or fewer beyond the Promised Shipment Date, the notice will inform the Customer that non-response prior to shipment will be treated as consent to the delay. The Customer may cancel at any time before shipment.
5.4 — Where the revised date falls more than thirty (30) days beyond the Promised Shipment Date, or where no definite date can be given, the order will be automatically cancelled and refunded unless the Customer affirmatively consents to the delay or the Brand ships within thirty (30) days of the Promised Shipment Date having received no cancellation. Silence does not constitute consent in this circumstance.
5.5 — Where a further delay follows a revised date to which the Customer has consented, the Brand will issue a second notice. Non-response to a second notice never constitutes consent. Absent affirmative consent, the Brand will cancel and refund.
5.6 — Refunds under this Section are issued without the Customer having to request them, to the original instrument of payment: for card transactions, within one billing cycle; for all other instruments, within seven (7) Business Days.
5.7 — The Brand will not substitute alternative Goods without the Customer's express prior consent.
5.8 — The Brand's Final Sale policy governs Goods that have been delivered. It does not operate to defeat the Customer's right under this Section to cancel an unshipped order that has been delayed past the Promised Shipment Date.
6. SHIPPING RATES
6.1 — Shipping charges are computed at checkout by reference to destination and dimensional weight, and are displayed prior to payment authorization.
6.2 — Standard shipping is complimentary on orders exceeding $150. The threshold is computed on the merchandise subtotal after discount and before tax and shipping. Unless otherwise stated at the point of promotion, the threshold applies to domestic destinations.
6.3 — Where an order qualifying for complimentary shipping is subsequently reduced below the threshold by cancellation or remedy of a constituent item, the Brand reserves the right to deduct the standard shipping charge from any refund issued.
6.4 — Shipping charges are non-refundable except where the Brand cancels an order under Section 5, or where the Brand has committed a fulfillment error as defined in the Return, Refund, and Exchange Policy.
6.5 — Post Office Box addresses are serviceable by United States Postal Service only.
6.6 — Shipments to APO, FPO, and DPO addresses are dispatched by United States Postal Service exclusively and are subject to extended, non-guaranteed Transit Times.
7. CONFIRMATION AND TRACKING
7.1 — An order acknowledgment is emailed upon payment authorization. It confirms receipt and states the Processing Window. It does not indicate that the consignment has shipped.
7.2 — A shipment notification bearing a tracking identifier is emailed upon carrier tender.
7.3 — Tracking data may not populate for up to forty-eight (48) hours following carrier tender. Absence of scan history within that interval indicates carrier scanning latency rather than non-shipment.
7.4 — Customers are directed to inspect spam, promotions, and junk folders before reporting non-receipt of correspondence. The Brand is not responsible for notifications filtered or misdirected by the Customer's mail provider, nor for correspondence sent to an address entered erroneously by the Customer.
7.5 — Order status is available at any time by written inquiry to Support@Davison.com, citing the order number.
8. TITLE, RISK OF LOSS, AND DELIVERY
8.1 — Title and risk of loss pass to the Customer upon carrier tender. Thereafter the consignment is in the Customer's constructive possession.
8.2 — The Brand is not a carrier and disclaims responsibility for routing, handling, custody, and delivery performance following carrier tender.
8.3 — Delivery is effected upon the carrier's deposit of the consignment at the address specified by the Customer, whether or not the Customer is present to receive it.
8.4 — Where the Customer has furnished delivery instructions directly to the carrier — including release authorization, redirection, or deposit at an unattended location — the Customer assumes all attendant risk, and the Brand's obligations are discharged upon delivery in accordance with those instructions.
9. LOST, STOLEN, AND UNDELIVERED CONSIGNMENTS
9.1 — A consignment recorded by the carrier as delivered is deemed delivered. Where non-receipt is reported, the Customer is directed to inspect the perimeter of the address, inquire of household members and building management, await forty-eight (48) hours (premature scanning is common), and file a claim with the carrier.
9.2 — The Brand does not replace or refund consignments recorded as delivered. Such circumstances constitute theft or carrier misdelivery, and recourse lies against the carrier and, where appropriate, local law enforcement. The Brand will furnish tracking documentation, proof of tender, and any available delivery photograph in support.
9.3 — Where tracking shows no scan activity for ten (10) consecutive Business Days domestically or thirty (30) consecutive calendar days internationally, the Customer should notify the Brand and a carrier trace will be initiated. Traces ordinarily conclude within seven to fourteen Business Days.
9.4 — Where a trace concludes that a consignment is lost, and shipping protection or carrier insurance was purchased or applied to that consignment, the Brand will replace the Goods where inventory permits or refund upon resolution of the claim. Where no such protection was in force, the risk allocation at § 8.1 governs.
9.5 — Where shipping protection is offered at checkout and declined by the Customer, the Customer assumes the corresponding risk of loss, theft, and misdelivery in full.
9.6 — Claims of non-receipt must be raised within thirty (30) calendar days of the last recorded tracking scan. Claims raised thereafter cannot be pursued, as carrier claim windows will have expired.
10. ADDRESS ACCURACY AND RETURNED CONSIGNMENTS
10.1 — The Customer bears sole responsibility for the accuracy and completeness of the delivery address, including unit, apartment, and suite designation.
10.2 — Address correction is available without charge prior to carrier tender by written request to Support@Davison.com. Following tender, the Brand cannot redirect a consignment.
10.3 — Consignments delivered to an address furnished erroneously by the Customer are the Customer's responsibility in full and are not eligible for replacement or refund.
10.4 — Consignments returned as undeliverable — by reason of address error, refusal, or failure to retrieve from a carrier holding facility — will be reshipped only upon remittance of a second shipping charge.
10.5 — Where reshipment is declined, the Brand will refund the merchandise value less original shipping and less any carrier return charge assessed. Where the Customer neither remits reshipment charges nor requests a refund within thirty (30) calendar days of the Brand's notice, the Goods are deemed abandoned.
11. INTERNATIONAL SHIPMENT, DUTIES, AND CUSTOMS
11.1 — The Brand ships worldwide, subject to § 11.7.
11.2 — International Goods are sold Delivered Duty Unpaid. Import duties, value-added taxes, customs brokerage fees, and destination-country levies are the exclusive obligation of the Customer and are assessed independently of amounts collected at checkout. These charges are levied by the destination government, not by the Brand, and the Brand receives no portion of them.
11.3 — The Brand does not undervalue consignments, does not declare commercial goods as gifts, and does not falsify customs documentation under any circumstance.
11.4 — Customs inspection, clearance, and administrative processing occur outside the Brand's control and are excluded from all Transit Time estimates. Clearance may add days or, in some jurisdictions, weeks.
11.5 — Refusal to remit assessed duties resulting in seizure, destruction, abandonment, or return of a consignment does not entitle the Customer to refund.
11.6 — The Customer bears responsibility for ascertaining that the Goods may lawfully be imported into the destination jurisdiction.
11.7 — The Brand does not dispatch to jurisdictions subject to comprehensive United States trade sanction, nor to any person or entity appearing on a restricted-party list maintained by the United States Government. The Brand further reserves the right to decline any order to any destination in its sole discretion. Orders so declined are refunded in full within seven (7) Business Days.
11.8 — International Customers are reminded that the defect claim window set forth in the Return, Refund, and Exchange Policy runs from the carrier-recorded delivery scan and is not extended by reason of international transit.
12. FORCE MAJEURE
12.1 — The Brand shall not be liable for failure or delay in performance attributable to circumstances beyond its reasonable control, including acts of God, meteorological or seismic event, conflagration, epidemic, public health directive, war, civil disturbance, terrorism, labor action, carrier network failure, utility interruption, cyber incident, governmental action, port congestion, and material supply interruption.
12.2 — A force majeure event suspends the Brand's performance obligation. It does not suspend the Brand's obligations under Section 5. The Brand will issue a delay notice, state the revised date or its inability to state one, and honor the Customer's right to cancel and receive a refund.
12.3 — Where such an event renders performance permanently impracticable, the Brand will cancel the affected order and refund in full.
13. LIMITATION OF LIABILITY
13.1 — To the maximum extent permitted by applicable law, the Brand's aggregate liability arising from shipment, delay, or non-delivery shall not exceed the purchase price actually remitted for the Goods giving rise to the claim, together with shipping charges paid.
13.2 — The Brand bears no liability for indirect, incidental, consequential, special, exemplary, or punitive damages arising from delay or non-delivery, including forfeited competition entry, missed event, lost registration fee, or reputational detriment.
13.3 — Nothing in this Section excludes liability for fraud or willful misconduct, or any liability that cannot lawfully be limited, nor abridges any entitlement conferred by 16 C.F.R. Part 435 or applicable state consumer protection law.
14. GOVERNING LAW
14.1 — This Policy is governed by the laws of the State of California, without regard to its conflict of laws principles.
14.2 — The parties shall endeavor in good faith to resolve any dispute through direct negotiation for not fewer than thirty (30) days before commencing formal proceedings.
14.3 — Unresolved disputes shall be submitted to the state or federal courts situated in Los Angeles County, California, to whose jurisdiction the parties consent. Nothing herein precludes either party from pursuing a claim in small claims court where jurisdictional thresholds are satisfied.
14.4 — Should any provision be adjudged invalid or unenforceable, that provision shall be severed and the remainder shall continue in full force.
